General terms of rental
Terms applicable to the seasonal rental of the cottages Sand Baya and Le Cottage du chemin des chênes, operated by LA RIBREAUTIÈRE SAS.
1. Parties to the contract
This contract is concluded between LA RIBREAUTIÈRE SAS (SIREN 940 322 209), a French simplified joint-stock company with capital of €15,000, headquartered at 3 rue de l'Aubépine, 85110 Chantonnay, France, hereinafter "the Lessor", and the customer, hereinafter "the Lessee".
2. Subject matter
The Lessor rents to the Lessee one or both of the following furnished tourist accommodations, located at 2 la Rousselière, 85140 Les Essarts (Vendée, France):
- Sand Baya: 60 m², 2 bedrooms, maximum capacity 6 guests
- Le Cottage du chemin des chênes: ≈ 60 m², 2 bedrooms, maximum capacity 6 guests
- Whole-estate booking: maximum capacity 12 guests
- For creative retreats, sleeping capacity is intentionally limited to 8 participants (one individual bed each, no sofa bed unfolded)
3. Duration and arrival
The stay runs from the arrival date to the departure date stated in the booking confirmation. Minimum duration varies by season (see rate grid). Arrival is autonomous at any time thanks to a smart lock with dynamic code communicated the day before. Departure is expected by 11 AM at the latest.
4. Price and payment terms
All prices are in euros, all taxes included. The SAS benefits from the VAT exemption provided in article 261 D-4° of the French General Tax Code (rental of furnished accommodation without para-hotel services). Invoices include the mention "VAT not applicable, art. 261 D-4° of the French General Tax Code".
Included in the nightly price: end-of-stay cleaning, bed and bath linen, beds made on arrival. The flat cleaning fee of €90 is added to the total. The local tourist tax is invoiced separately, per person and per night, in accordance with the rate set by the Essarts-en-Bocage municipality.
Terms: a 30 % deposit is paid upon booking confirmation. The balance is due no later than 30 days before arrival. Payment methods: credit card or wire transfer.
5. Security deposit
A security deposit is required for each stay, managed via the Swikly platform. A securing link is sent to the Lessee after confirmation. No amount is charged unless damage is observed at departure.
Deposit amount: to be set in the booking confirmation (suggested: €500 per cottage, €1,000 for whole-estate booking). Swikly fees are borne by the Lessee. The deposit is released within 7 days of departure, subject to no damage.
6. Cancellation by the Lessee

Any cancellation must be notified by email to [email protected]. The notice period is calculated from the date the email is sent.
7. Cancellation by the Lessor
If the Lessor is unable to host the Lessee (damage, construction delay, force majeure), the Lessor undertakes to refund all amounts paid within 14 days of notification.
8. No right of withdrawal
In application of article L. 221-28, 12° of the French Consumer Code, the seasonal rental contract for accommodation on a specific date or period is not subject to the 14-day right of withdrawal provided in article L. 221-18 of the same code. The Lessee therefore cannot withdraw after booking confirmation, without prejudice to the cancellation conditions defined in article 6 above.
9. Lessee's obligations
- Respect the maximum capacity stipulated (6 guests per cottage, 12 for whole-estate)
- Use the premises peacefully and as a careful tenant
- Refrain from any subletting or assignment
- Pets not allowed
- No smoking inside the cottages
- Comply with the house rules, attached to the booking confirmation
- Return the premises clean and in good condition
- Hold a holiday rental insurance (extension of the home multi-risk policy), proof to be presented on arrival
10. Liabilities
The Lessor guarantees that the rented premises conform to the description and are in good usable condition. The Lessee is liable for any damage they cause, as well as damage caused by any person admitted to the cottage.
11. Force majeure
Contractual obligations are suspended in case of force majeure within the meaning of article 1218 of the French Civil Code (unforeseeable, irresistible and external event preventing performance). If the impediment lasts more than 30 days, either party may terminate the contract without indemnity.
12. Consumer mediation
In accordance with article L. 612-1 of the French Consumer Code, after a written complaint that has remained unresolved for 60 days, the Lessee may refer the matter free of charge to the mediator:

13. Personal data
Data collected in the context of the booking is processed in accordance with the GDPR. See our privacy policy for details on processing, retention and rights.
14. Applicable law and jurisdiction
This contract is governed by French law. In case of a dispute with a consumer residing in the European Union, the competent jurisdiction is determined according to the Brussels I bis Regulation (art. 18). The court of the consumer's domicile has jurisdiction at the consumer's choice.
